Chapter 7 Bankruptcy Waiting Periods
Chapter 7 is a full liquidation — most unsecured debts are discharged. Waiting periods from discharge date: FHA: 2 years. VA: 2 years. USDA: 3 years. Conventional: 4 years from discharge (2 years with documented extenuating circumstances such as job loss, serious illness, or divorce).
Chapter 13 Bankruptcy Waiting Periods
Chapter 13 is a repayment plan — debts are reorganized and partially repaid over 3 to 5 years. Waiting periods vary because Chapter 13 can be ongoing at application time. FHA and VA: 1 year of on-time plan payments with court trustee approval. Conventional: 2 years from discharge or 4 years from dismissal.
Non-QM Financing: Earlier Options
Several non-QM lenders offer mortgage programs with no mandatory waiting period after bankruptcy discharge — subject to larger down payments, higher rates, and other credit compensating factors. These are viable for buyers who need to purchase before the standard waiting periods expire.
What to Do During the Waiting Period
Rebuild credit aggressively. Secured credit cards, credit-builder loans, and becoming an authorized user on an account with a positive history all help. Maintain zero late payments from the moment of discharge. Build savings and reserves. Document the circumstances that led to the bankruptcy — extenuating circumstance documentation can shorten waiting periods on some programs.
